Battat Recalls Magnetic Construction Sets; Ingested Magnets PoseAspiration and Intestinal Hazards

Name of Product: Battat Magnabild Magnetic Building Systems

Hazard: Small magnets inside the building pieces can fall out. Magnets found by young children can be swallowed or aspirated. If more than one magnet is swallowed, the magnets can attract each other and cause intestinal perforations or blockages, which can be fatal.

Incidents/Injuries: CPSC and Battat have received 16 reports of magnets coming out of the long flexible rods, 1-inch rods, and of the corners of square building pieces. No injuries have been reported.

Description: This recall involves the 293-piece (item number BB1502H) and the 180-piece (item number BB1431H) Magnabild Magnetic Building System sets. Both sets come in rotating display cases that contain 1-inch and 4-inch rods with magnets, curved 1-inch rods, triangle and square pieces with magnets, square-shaped plastic building pieces, triangles and 5-sided pieces, and metal balls. The pieces come indifferent colors. All of the plastic building pieces, except the 4-inch flexible rods, have the word "Magnabild" in raised lettering on them. The item number is found on a hang tag attached to the set. The productis designed for children older than three years.

Botulism, a potentially fatal form of food poisoning, can cause the following symptoms: general weakness, dizziness, double-vision, and trouble with speaking or swallowing. Difficulty in breathing, weakness of other muscles, abdominal distension and constipation may also be common symptoms. People experiencing these problems should seek immediate medical attention.

Frozen Salted/Dried Yellow Croaker was distributed in New York, New Jersey and Maryland area. It reached consumers through retail stores. This product comes in a clear plastic bag and is individually tied with rope.

The potential for contamination was noted after routine testing. No illnesses have been reported to date in connection with this problem.

AM2 PAT, Inc. Issues Nationwide Recall of All Lots and All Sizes of Pre-Filled Heparin and Normal Saline Flushes

AM2 PAT, Inc., Angier, North Carolina, is initiating a Nationwide recall of all lots of both Heparin and Saline pre-filled flushes manufactured by AM2 PAT. These products are distributed under two brand names, Sierra Pre-Filled Inc. and B. Braun. These products are sold in 3ml, 5ml sizes for Heparin and 3ml, 5ml and 10ml sizes for Normal Saline. Both products are sold as pre-filled syringes.

One lot under recall of this product 1003-02, Lot 070926H, heparin IV flush syringes has been found to be contaminated with Serratia marcescens, which has resulted in patient infections. CDC has confirmed growth of Serratia marcescens from several unopened syringes of this product.

This type of bacterial infection could present a serious adverse health consequence that could lead to life-threatening injuries and/or death.

Consumers and user facilities who have any of these recalled pre-filled syringes, Heparin or Saline Lock Flush Solution USP, should stop using the product immediately. These products should be immediately quarantined in your inventory and returned to your distributor immediately.

The firm voluntarily recalled these products after confirming bacterial contamination in some end user samples of product code 1003-02, Lot 070926H.

Stamina Products to Pay $105,000 Civil Penalty for Failure to ReportDefects with Mini-Trampolines

The U.S. Consumer Product Safety Commission (CPSC) announced today that a Missouri-based manufacturer of trampolines has agreed to pay the government a $105,000 civil penalty.

The penalty settles allegations that Stamina Products, of Springfield, Mo., failed to report in a timely manner injuries from defective mini-trampolines.

In April 2006, CPSC and Stamina Products announced the recall of about 668,000 mini-trampolines. Between April 2002 and June 2005, Stamina Products received eight reports from consumers who alleged that the trampoline sprang back during the folding/unfolding process causing facial lacerations that required stitches, broken teeth, bruises, headaches, neck pain, broken facial bones, loss of mouth sensation, and blurred vision.

Stamina Products failed to report these incidents to the CPSC in a timely manner. CPSC was finally informed of the incidents in July 2005. Federal law requires firms to report to CPSC within 24 hours after obtaining information that a product contains a defect which could create a substantial product hazard, or creates an unreasonable risk of serious injury or death. In agreeing to settle the matter, Stamina Products denies that it violated federal law.

Nordstrom Recalls Taper and Votive Candles Due To Fire Hazard

Name of Product: Nordstrom "At Home" Taper and Votive Candles

Units: About 2,500

Importer: Nordstrom Inc., of Seattle, Wash.

Hazard: The candle's exterior coating can ignite, posing a fire hazard.

Incidents/Injuries: Nordstrom has received four reports of flames or smoke coming from the candle or the exterior coating. One instance of property damage was reported but no injuries have been reported.

Description: This recall involves Nordstrom "At Home" 10-inch taper candles and Nordstrom "At Home" votive candles. The taper candles were sold under style numbers NR-07059G and NR-07059S. The votive candles were sold under style numbers NR-07001G and NR-07001S. The candles came in silver and gold and were sold in a box of six. The style number can be found on a sticker at the bottom of the packaging.

Manufactured in: Taiwan

Sold at: Nordstrom stores nationwide from September 2007 through December 2007 for about $18 for the taper candles and about $12 for the votive candles.

Remedy: Consumers should stop using these candles immediately and return them to any Nordstrom store for a full refund.

This type of bacterial infection could present a serious adverse health consequence that could lead to life-threatening injuries and/or death.

Harry and David Issues Nationwide Allergy Alert on Undeclared Peanuts and Other Nuts in Harry and David Giant Cashews

Harry and David, of Medford, Oregon, is voluntarily recalling approximately 2130 boxes of 4 oz. Harry & David Giant Cashews because they may contain mixed nuts, including peanuts, almonds, pecans and Brazil nuts not declared on the ingredient statement. People who have an allergy or severe sensitivity to these ingredients (peanuts, almonds, pecans and/or Brazil nuts) run the risk of serious or life-threatening allergic reaction if they consume these products.

The affected product was distributed throughout the United States only through Harry and David Stores beginning 11/16/07.

Harry and David is recalling all 4 oz. boxes of Giant Cashews with lot codes 2507 MSL 15:00 through 2507 MSL 18:00 and a use by date of 6/28/08. The lot code and use by date are ink jetted on the bottom of the box. Affected boxes also can be recognized by the price sticker on the bottom, or lower portion of the back, of the box. The price sticker states "Nuts Mixed Nuts Box 4oz". These products are packaged in 4 oz. paperboard boxes with bags of metalized film containing nuts inside. The boxes are olive green with a pale green design in the background.

There have been no illnesses or injuries reported to date. Anyone concerned about an illness/injury should contact a physician immediately.

This problem occurred during a product changeover when packaging for cashews was comingled with packaging for the mixed nuts.

Deli Chef Tri-Bean Salad Recalled From Some Kroger Stores

Inter-American Products, a division of The Kroger Co. (NYSE: KR), today announced a voluntary recall on all codes of Deli Chef Tri-Bean Salad sold from store deli counters in some states because the product has the potential to be contaminated with Clostridium botulinum, a bacterium which can cause a potentially life threatening condition called botulism. Consumers should not consume this product even if it does not look or smell spoiled.

The Tri-Bean Salad was sold at deli counters in stores in Colorado, Illinois, Indiana, Kansas, Kentucky, Michigan, Missouri, Nebraska, Ohio, New Mexico, Utah, Washington, West Virginia, and Wyoming.

No illnesses have been reported. No other salad products are affected by this recall.

Description: The self-assembled, wooden play stove is painted pink with six white knobs and a timer. The dimensions of the stove when assembled are 11 1/2" W x 13 3/4" D x 32 7/8" H.

L’Oréal Initiates Nationwide Recall of L’Oréal Paris Dream Blonde Bleach and Lightening Care Kit Due to Misprinted Directions

L'Oréal Paris, a division of L'Oréal USA, has initiated a voluntary recall from retail stores in the United States for the L'Oréal Paris Dream Blonde (Baby's Breath Blonde #100 Ultra Lightening) Bleach and Lightening care kit. The product was sold in retail outlets in the US from January 1 through January 18, 2008. L'Oréal is voluntarily taking this action due to an error in the printing of the directions for the use of the Dream Blonde Bleach and Lightening care kit. All retailers have been notified and have removed the product from their shelves. Affected consumers, estimated at a few hundred, will receive a full refund for returned product.

L'Oréal took immediate action following one customer complaint of the product causing irritation. The Dream Blonde Bleach and Lightening Care formula itself is safe. However, if used according to the current misprinted directions, complications such as irritation or sensitivity could result, so consumers should not use the product and should instead return it to their retailer for a refund. As with any product, if a consumer feels they are having any type of reaction or irritation, they should consultant their physician. This recall affects only the Dream Blonde Bleach and Lightening care kit in the Dream Blonde range of products.

New Era Canning Company Announces New Nationwide Recall of Green Beans and Garbanzo Beans in #10 cans (6 to 7 pound cans)

New Era, MI – January 18, 2008 --- New Era Canning Company of New Era, Michigan is recalling all cans of green beans and garbanzo beans in #10 cans (large cans containing between 6 and 7 pounds) because they may have been processed under conditions which could have led to contamination by Clostridium botulinum bacterium spores, which can cause life-threatening illness or death. The codes on the affected product begin with the numbers “00249,” or the letters “GREEN” or “GARB”. This recall does not include Italian Green Beans because that is a different product.

Clostridium botulinum bacterium spores have the potential for growth that produces a toxin that causes a potentially fatal form of food poisoning - botulism. Symptoms of botulism poisoning in humans can begin from 6 hours to 2 weeks after eating food that contains the toxin. Symptoms may include double vision, blurred vision, drooping eyelids, slurred speech, difficulty swallowing, and muscle weakness that moves progressively down the body, affecting the shoulders first, then descending to the upper arms, lower arms, thighs, and calves. Botulism poisoning also can cause paralysis of the breathing muscles, which can result in death unless assistance with breathing (mechanical ventilation) is provided. Individuals who have these symptoms and who may have recently eaten the green beans or garbanzo beans currently under recall or other food products made with these items should seek immediate medical attention.

The issues were uncovered in a FDA inspection of products that were in the company’s possession. NO product has tested positive for the toxin and there have been NO cases of botulism reported from these products.

This recall only affects the products in the large #10 cans, the majority of which were potentially sold nationwide to various food service customers. However these products may also have been purchased by consumers at retail stores. The code on the cans may be embossed (stamped into the metal of the can) or printed in ink on one of the metal can ends.

Examples of how a code may appear on a can of green beans are: "00249 2BH7FL", "00249 1515 2BH7FL", "GREEN 2BH7FL" or "GREEN 1515 2BH7FL". (These are not necessarily actual can codes).

Examples of how a code may appear on a can of garbanzo beans are: "00249 34F7LG", "00249 1515 34F7LG", "GARB 34F7LG" or "GARB 1515 34F7LG". (These are not necessarily actual can codes).
New Era Canning, in conjunction with the US Food and Drug Administration and the Michigan Department of Agriculture, is thoroughly evaluating all processes and procedures to determine the cause of the problem.

Any food that may be contaminated should be disposed of carefully. Even tiny amounts of toxins ingested, inhaled, or absorbed through the eye or a break in the skin can cause serious illness. Skin contact should be avoided as much as possible, and the hands should be washed immediately after handling the food. Customers who have the product or any foods made with these products should throw them away immediately. Double bag the cans in plastic bags that are tightly closed, then place in a trash receptacle for non-recyclable trash outside of the home. Restaurants and institutions are encouraged to assure that such products are only placed in locked receptacles which are not accessible to the public. FDA Warns Public of Possible Botulism Risk

New Era Recall Expanded for Canned Green Beans and Garbanzo Beans

The U.S. Food and Drug Administration (FDA) today announced that New Era Canning Company, New Era, Mich., is expanding its product recall because of potential Clostridium botulinum (C. botulinum) contamination to all canned green beans and garbanzo beans distributed by the company nationwide over the last five years. C. botulinum can cause botulism, a serious and sometimes life-threatening condition. The affected cans are large institutional-sized containers, weighing approximately six and a half pounds.

Symptoms of botulism poisoning in humans can begin from 6 hours to 2 weeks after eating food that contains the toxin. Symptoms may include double vision, blurred vision, drooping eyelids, slurred speech, difficulty swallowing, and muscle weakness that moves progressively down the body, affecting the shoulders first, then descending to the upper arms, lower arms, thighs, and calves. Botulism poisoning also can cause paralysis of the breathing muscles, which can result in death unless assistance with breathing (mechanical ventilation) is provided. Individuals who have these symptoms and who may have recently eaten the products under recall or other food products made with them should seek immediate medical attention.

To date, no illnesses have been reported to the FDA; however, consumers should not consume these products, even if they appear to be normal, because of the potential serious risk to health. Consumers who have the affected products or who have used them in recipes should immediately throw the cans and food away.

New Era took this voluntary action in the interest of public health in accordance with FDA's recall request. The company is taking immediate action to retrieve all inventories of the products throughout the distribution chain, including consumers' homes, nursing homes, schools, warehouses, restaurants, retail stores, health care facilities, and other facilities.

Please note that New Era produces canned products under other brand names and labels. Therefore, the recalled products may not necessarily be labeled with New Era's name. Consumers who are not sure if a product is subject to the recall should still throw it out as a precaution.

Any food that may contain the recalled canned beans should be disposed of carefully. FDA and the Michigan Department of Agriculture launched a joint investigation of New Era's processing plant. This investigation resulted in the identification of C. botulinum contamination in several lots of canned green beans and one lot of garbanzo beans, the identification of serious food violations, and this expanded recall. Original findings of this investigation resulted in the company voluntarily recalling green beans in December 2007 (http://www.fda.gov/bbs/topics/NEWS/2007/NEW01764.html ), and green beans, Mexican-style chili beans, and dark red kidney beans in January (http://www.fda.gov/oc/po/firmrecalls/newera01_08.html ).

FDA initiated the inspection at New Era, along with inspections of other low acid canned food (LACF) manufacturers, following four cases of botulism in consumers who had consumed canned hot dog chili sauce in the summer of 2007. In light of these botulism cases, FDA increased its inspection efforts to assure that manufacturers of all types of LACF products are adhering to applicable FDA requirements. These actions illustrate the need for companies to operate under adequate preventive control systems.

As part of the ongoing investigation, FDA issued an Order of Need for Emergency Permit to New Era. This order prohibits the manufacture and shipment of the company's low acid canned foods across state lines until they demonstrate to FDA's satisfaction that the products are safe. In addition, the Michigan Department of Agriculture, under its state authority, has embargoed New Era's entire inventory of low acid canned products contained in the company's warehouses in Michigan. As a result, New Era is not currently distributing any products.

Prevention of foodborne illness is a key element of the FDA's new Food Protection Plan , launched November 6, 2007.

Raja Foods Issues Nationwide Recall on SWAD BRAND ABIL, GULAL, KANKU, KUM KUM, LAGAN SAMAGRI, AND POOJA SAMAGRI Containing High Levels of Lead

Raja Foods LLC of Skokie, Il is recalling its 3.5 oz. (100 g) packages of "SWAD BRAND: ABIL, GULAL, KANKU, KUM KUM," and "SWAD BRAND: LAGAN SAMAGRI KIT, and POOJA SAMAGRI KIT" because the product contains high levels of lead. Lead is very toxic and dangerous to humans, especially children, women of childbearing age, pregnant women and their unborn children. Although people with lead in their blood often do not exhibit the symptoms of lead toxicity, such symptoms include the following: stomach aches, colic, nausea, vomiting, abnormal irritability, and insomnia. Lead can also permanently damage the central nervous system, resulting in learning difficulties in school children as well as cause other long-term health problems.

These products were distributed through Indian grocery stores in Colorado, Georgia, Iowa, Illinois, Indiana, Kansas, Michigan, Minnesota, Missouri, Nebraska, New York, Ohio, Oregon, Tennessee, Texas, Washington and Wisconsin.

These products are used in India for religious purposes and are intended to be placed on the skin or hair. Although the product was not intended to be sold for food use, its labeling may be confusing and may imply it may be used as food. The ABIL, GULAL, KANKU,and KUM KUM product is distributed in a 3.5 oz. FDA Takes Action Against Compounded Menopause Hormone Therapy Drugs

The U.S. Food and Drug Administration (FDA) sent letters warning seven pharmacy operations that the claims they make about the safety and effectiveness of their so-called "bio-identical hormone replacement therapy," or "BHRT" products are unsupported by medical evidence, and are considered false and misleading by the agency. FDA is concerned that unfounded claims like these mislead women and health care professionals.
The pharmacy operations improperly claim that their drugs, which contain hormones such as estrogen, progesterone, and estriol (which is not a component of an FDA-approved drug and has not been proven safe and effective for any use) are superior to FDA-approved menopausal hormone therapy drugs and prevent or treat serious diseases, including Alzheimer's disease, stroke, and various forms of cancer.
FDA is concerned that the claims for safety, effectiveness, and superiority that these pharmacy operations are making mislead patients, as well as doctors and other health care professionals. Compounded drugs are not reviewed by the FDA for safety and effectiveness, and FDA encourages patients to use FDA-approved drugs whenever possible. The warning letters state that the pharmacy operations violate federal law by making false and misleading claims about their hormone therapy drugs.
"We want to assure that Americans receive accurate information about the risks and benefits of drug therapies," said Dr. Janet Woodcock, FDA's chief medical officer and acting director of the agency's Center for Drug Evaluation and Research. "In addition to today's regulatory action, FDA is publishing an informational article for women on its consumer health information web page that provides the facts to make informed decisions about these unapproved therapies. Women taking these drugs should discuss with their health care providers the drugs' risks and whether they're getting effective treatment."
The pharmacy operations receiving warning letters use the terms "bio-identical hormone replacement therapy" and "BHRT" to imply that their drugs are natural or identical to the hormones made by the body. FDA regards this use of "bio-identical" as a marketing term implying a benefit for the drug, for which there is no medical or scientific basis.
The pharmacy operations also make unsupported claims that their drugs are better than FDA-approved menopausal hormone therapy drugs and can be used to prevent and treat serious diseases such as Alzheimer's disease, stroke, and various forms of cancer.
The pharmacy operations compound hormone therapy drugs that contain estriol as well as progesterone and estrogen. No drug product containing estriol has been approved by FDA and the safety and effectiveness of estriol is unknown.
Firms that do not properly address violations identified in warning letters risk further enforcement, including injunctions that prevent additional violations, and seizure of violative drugs.
FDA's action today does not target pharmacists who practice traditional pharmacy compounding and who do not make false or misleading claims about compounded products. Traditional pharmacy compounding typically involves preparation of a drug for an individual patient by a pharmacist in response to a valid prescription from a licensed practitioner. This compounding follows a practitioner's decision that his or her patient has a special medical need that cannot be met by FDA-approved drugs. FDA also responded today to a citizen petition from Wyeth, Madison, NJ, asking FDA to take regulatory action against compounding pharmacy operations that produce compounded "BHRT" drugs. Other stakeholders, including health care providers and consumer groups, have also raised concerns about "BHRT" drugs.
All patients who use compounded hormone therapy drugs should discuss menopausal hormone therapy options with their health care provider to determine if compounded drugs are the best option for their specific medical needs. If patients or practitioners encounter problems with compounded hormone therapy drugs, they are encouraged to file a MedWatch report with the FDA at www.fda.gov/medwatch or by phone at 1-800-FDA-1088.

Description: This recall involves the Intermatic DT27 digital self-adjusting timer with a date code of "04B." This product is a lamp and appliance timer and is packaged as either the "DT27C Heavy DutyDigital Timer" or the "DT27CL Time All(r) Digital Lamp and Appliance Self-Adjusting Timer." The timer is white with a rounded top, and measures 3 7/8" tall by 2 3/4" wide by 1 5/8" deep. The brand name"Intermatic" is molded on the front of the timer, and the model number ("DT27") and date code ("04B") are printed on the back of the timer.

Sold at: Retailers nationwide, including Home Depot and Lowe's, from February 2007 through December 2007 for between $15 and $25.

Hunting Tree Stand Manufacturer Agrees To Pay $420,000 Civil Penalty

The U.S. Consumer Product Safety Commission (CPSC) announced today that a Wisconsin-based tree stand manufacturer has agreed to pay the government a $420,000 civil penalty. The penalty settles a government lawsuit alleging that Ardisam Inc, of Cumberland, Wis., failed to immediately report to the CPSC serious injuries to hunters with its Big Foot and Lite Foot series hunting tree stands.

In July 2004, 78,000 of these tree stands were recalled by the company. The lawsuit against Ardisam alleged that the company received reports of incidents beginning in April 2000, involving tree stands that unexpectedly detached from trees. These incidents resulted in broken bones or other serious injuries to hunters. The lawsuit alleged that Ardisam failed to immediately report this information to the CPSC as required by federal law. The lawsuit alleged Ardisam eventually reported to the CPSC in May 2004.

"The law is clear - companies must immediately tell CPSC about products that could pose a substantial risk or create an unreasonable risk of serious injury or death" said CPSC Acting Chairman Nancy Nord. "The quicker a company tells CPSC about a dangerous product, the quicker we can work to protect the health and safety of consumers."

Under the Consumer Product Safety Act, manufacturers, distributors and retailers are required to immediately report to the CPSC information about products that could create a substantial risk of injury or that create an unreasonable risk of serious injury or death. In resolving the lawsuit, Ardisam denied the allegations that it violated federal law or failed to immediately report to the CPSC. The Office of Consumer Litigation of the U.S. Department of Justice brought this case before the U.S. District Court for the Western District of Wisconsin on behalf of the CPSC.

Description: The recalled electric motor is part of a residential whole-house exhaust fan that is typically mounted on the floor of an attic. The shutters of the fan are visible on the ceiling of the floor beneath the attic and must be opened and closed by the consumer. The motors were included with exhaust fans manufactured and distributed by Air Vent Inc. and Triangle Engineering of Arkansas Inc. "A.O. Smith," the model number, and the service date code are printed on the rating plate of the motor. The recall includes model numbers S56A30A54 and S56A30A97, and service date codes 032076M - 334076M, 03207JY - 33407JY,and YB07 - YL07. Units that have a sticker indicating that the unit has been rewired are not subject to this recall.

Sold at: The recalled motors, included with the exhaust fans, were sold at home improvement stores nationwide or by professional installers or builders from February 2007 through November 2007 for about $3,000.
